March 2, 2008 I would like to update everyone on our progress toward opening Sun Valley MX Park. Just to back track a bit, on January 26, 2007 the Zoning Administrator approved the track and subsequently on June 12, 2007 the North Valley Area Planning Commission upheld the Zoning Administrators decision. However, on February 1, 2008, at the request of Councilmember Tony Cardenas, LA City Council voted to overturn the Zoning Administrators decision and stopped the track from opening. As a result, at this point I have no alternative but to ask the courts to overturn LA City Council's decision. In over 20 years of owning and operating my construction company I have never taken anyone to court or been taken to court. This is not something I want to do, but at this point I have no other option. I believe the decision taken by LA City Council was taken for political reasons as directed by Councilmember Tony Cardenas and was not based on any of the Zoning Administrator's information. I have received legal advice to the same affect and they are very confident we will be successful in court. The attorneys have advised me that it will take up to 8 months to get a ruling from the court. This has been a very frustrating process which has taken 4 1/2 years to date, however I now feel we will get a fair decision from the courts based on the Zoning Administrator's record of the facts. Once again thank you to everyone who has supported Sun Valley MX Park by attending meetings and writing letters of support. I will keep you updated on our progress.
